France Compensates Deportation Victims' Descendants

Decree, published on July 14, 2000, institutes reparations for orphans whose parents were victims of Anti-Semitic persecutions

Decree 2000-657 of July 13, 2000, stipulates that anyone with a parent who was deported from France as part of the anti-Semitic persecutions during the Occupation and who died during deportation is entitled to reparations, provided they were under 21 at the time of deportation.

The decree, published in the Journal Officiel of July 14, may be consulted in English on this site and in French on the "Légifrance" site (www.legifrance.gouv.fr).

Reparations consist either of a cash indemnity of FF 180,000 or a lifetime monthly payment of FF 3,000, to be determined by the beneficiary. The exact modalities for making payments to foreign accounts in foreign currencies will be specified in the future.

Anyone receiving an indemnity from Germany or Austria in compensation for the same event is ineligible.

Any concerned party, regardless of nationality, residing abroad, may address a claim to the following address:

Applicants residing abroad may also file claims with the French Embassy or Consulate in their country of residence. In this case, the offices who register the claim will verify that it is accompanied by the necessary documents and will send it directly to the Direction des statuts, des pensions et de la réinsertion sociale in Caen. The decision to provide compensation takes four months from the receipt of the final document required by that administration. The department will issue a receipt for the initial application, but not for subsequent mailings.

The following documents are required:

- the applicant's birth certificate,
- certificate of the death or disappearance of parent(s) who died or disappeared during deportation,
- an attestation that the applicant does not receive reparations from Germany or Austria for the deportation of his parent or parents,
- specification of the cash indemnity or lifetime monthly payment option,
- bank or postal account number.

If original certificates cannot be produced, certified true copies will be accepted. Documents in foreign languages must be translated. Death during deportation is generally listed in the requested death certificates. If that is not the case, additional research will be performed by the Direction des statuts, des pensions et de la réinsertion sociale in the various archives at its disposal./.
